The McKinney-Vento Homeless Assistance Act and New York State Education Law work together to assist students experiencing homelessness.
The McKinney-Vento Act states that children and youth who lack "a fixed, regular, and adequate nighttime residence" will be considered homeless, have a right to receive a free and appropriate public education, and are to enroll in school immediately, even if they lack the documents normally required for enrollment, or if they’ve missed enrollment deadlines while experiencing homelessness.
The Phelps-Clifton Springs Central School District has a McKinney-Vento Liaison to assist students experiencing homelessness. The District's McKinney-Vento Liaison is Andrea Eldridge, Director of Special Programs & Services. Below is a list of rights provided to every student eligible under McKinney-Vento:
- To receive a free and appropriate public education;
- To enroll in school immediately, even if they lack the documents required for enrollment or have missed application or enrollment deadlines during any period of homelessness;
- To enroll in school and attend classes while the school gathers needed documents;
- To continue attending the school of origin, or enroll in a local school if the school of origin is not in the best interest of the student or is contrary to the request of a parent, guardian, or unaccompanied youth;
- To receive transportation to and from the school of origin, if requested by the parent or guardian, or by the local liaison on behalf of an unaccompanied youth; and
- To receive educational services comparable to those provided for other students, according to each student's individual needs.
